Appeals are decided by panels of three judges working together. The appellant presents legal arguments to the panel, in writing, in a document called a “brief.” In the brief, the appellant tries to persuade the judges that the trial court made an error and that its decision should be reversed.

If your appeal against the conviction is successful, the court will either order a new trial with a different judge and jury or find you not guilty.

If your appeal against the harsh sentence is successful, the court may reduce the sentence or impose a different sentence.

An appeal is when someone who loses a case in a trial court asks a higher court (the appellate court) to review the trial court’s decision.

Whether a LEGAL mistake was made in the trial court; AND. Whether this mistake changed the final decision (called the “judgment”) in the case.
